|
|
Hey Everyone!
I've found plenty of discussions on what agent exclusivity means around here. However, I have a few questions for all of you with multiple agents. These questions are mostly directed towards your "non-local" agents - out of state.
If you have more than 2+ agents do you find that most of them have geographical exclusivity clauses in their terms? (Example: All work obtained within a 200 mile radius of Chicago must be booked through us, the agency)
If yes, do you negotiate OUT of exclusivity?
If not, do you find it a royal pain in the ass to ensure that agents' exclusivity boundaries don't overlap? It seems overwhelming to have to keep tabs on geographical location of every new gig to ensure it doesn't "violate" one of your agents' exclusivity terms.
[insert, yet, another sentence with the word "exclusivity" here]
Thanks everyone! _________________ http://jordanreynolds.com |

I have 5 agents. 2 are out of state. No exclusivity clauses with any of them, in any way, shape or form. _________________ Scott R. Pollak

Thanks Scott.
Is that because you negotiated exclusivity clauses OUT of their initial terms? Or all 5 agents just simply had non-exclusive contracts?

None had any exclusivity written into their contracts. None had any restrictions whatsoever. _________________ Scott R. Pollak

Jordan,
I have 8 agents and only 1 has exclusivity, that's the agency in Pittsburgh and Cleveland that I've been signed with since 1996. The exclusivity is limited to those 2 metropolitan regions. I haven't tried to negotiate that part of my contract out with them because of my long-standing and highly profitable relationship with them. None of my other agents (not even my NYC agent) requires any exclusivity. _________________ Be well,

If you are on the West coast, they like to have exclusivity in your metropolitan area. I had 3 separate agents for a while in SoCal. San Diego, Orange County and LA. The San Diego agent opened an office in Orange County, so I had to choose.
On the East coast, I have not found this to be the case - except for that agent in Pittsburgh and Cleveland that Bob mentioned. _________________ Playing for a living...

Meant to add something...
My LA agent, who I do not have anymore - subscribed to Voicebank leads and the first time I got the same audition from New York and LA, he practically had a fit about it. He was just starting a VO section in his agency, so I am not sure he understood how things worked with Voicebank. _________________ Playing for a living...

Thanks for the comments everyone. Interesting. I currently have 4 agents, 2 of which have exclusivity terms. However, one is my local Denver agent which I can understand.
So based on the feedback it is very uncommon for agents to have exclusive terms.
Thanks again! _________________ http://jordanreynolds.com |

Agents are licensed by the state to be an employment agency. Technically their realm ends at the state lines. SAG/AFTRA sees agents domains as extending to the area of dominant influence i.e. Chicago does not conflict with Milwaukee. As for VO, because we can cross state lines, exclusivity is tricky. I would be exclusive in a market but not nationwide. I have multiple agents, am exclusive with my On Camera/VO agent in Chicago for anything they generate or that comes through one of the local casting offices. But I do have several other agents through which I get work.
Hope that helps! _________________ Pam Tierney
