Well, I DON'T have the place in Burbank after all. After assuring me on the phone that she had chosen me as the tenant, the prospective landlady wrote last night to say they had decided to rent the place to someone else.

She sent me the lease via email Saturday evening. I had my lawyer go over it with me yesterday and we found some errors like:

Quote:
UTILITIES. Tenant shall be responsible for arranging for and paying for all utility services required on the Premises. Costs for such utility services shall be included within Tenant’s monthly rental payment,


It shouldn't be in there both ways.

and
Quote:
LATE CHARGE. In the event that any payment required to be paid by Tenant hereunder is not made within three (5) days of when due,


it's either 3 or 5, right?

I pointed these discrepancies and asked to have in the lease the things we discussed when I came to see the place, like that Dieter will be able to come and stay for a couple of weeks at a time.

This morning I woke up to find an email saying they're going to rent to someone else.

Mega meh, but I am glad to know NOW that the landlady could be so mercurial.

I pray you will find a place that is just right and agree that it's better to know before you signed the lease that things were flaky on their end.

Let me point out that Burbank and Glendale do not have rent control.

The landlord/owner can stipulate anything into the lease/rental agreement that they like, so as long as you agree to it then that's the agreement. Because of the rent control in LA, the landlords in areas around USC and UCLA take advantage of the students with contract like these. Making for high rent and cruddy conditions.

Utilities. I'm guessing this is a home. So you're responsible for phone, gas, electrical, water, trash. Then items like gardener are built into the rent. It seems like they are trying to lump everything together without clarification.


The 3 to 5 day thing looks like a typo. As you may know, generally when the lease or legal document is written up and numbers are stipulated, they usually write it out like this: "Rent due within five (5) days."


It seems like they are a little dingy, anyway. Be glad you didn't get it.

Wow. Bullet dodged indeed! I'm sad for you, but I think I'm mostly relieved for you. Best to find these things out when you and a landlord are just dating and not after you've already moved in together.
