Oh boy— a spot I recorded for WBZ radio just showed up as the VO for a TV ad on 'BZ TV.
Nobody made any arrangements with ME. Heads will roll. Or I at least want a penalty. This is theft, and I object. _________________ DBCooperVO.com

Be flattered that they thought enough of the v.o. to do a lift for t.v. and consider that someone unfamiliar with the conditions of your original agreement must have assumed they had full rights to the original recording.
I;ve had this sort of thing happen by some top ad agencies, whereby they will use something for tradeshows, internet, etc. without knowing there are additional fees to pay.
Sadly we may only be aware of this happening and/or will receive satisfaction in only a small number of instances.

These people should know! I am a staff announcer for CBS radio.
I did the spot for CBS Radio.
If it was an agency lift it makes it even more heinous.
Even if it was just an AE's decision they should know better— we are obviously a union shop.

It makes me yell "woohoo, I got a pay check coming to me".
I'm not sure when the clients all started becoming crooks and creeps in the eyes of voice talent.
I have a close friend who runs a production studio. He brought talent in last year for a record session and he handles the booking and payments. Let's call his production company "Charlie Productions".
The client for this job was Frank's Website company. Frank was having Charlie produce some audio to be used in an online video for Big Pisano Pizza.
A year later and unfortunately Frank has gone out of business. The Big Pisano Company has found another web developer named Bill's Do everything Agency. Bill see's this pretty cool piece of video on the website and convinces Big Pisano that it would make a great radio spot and tv spot.
One of the talents is sitting at home and sees the spot on a local tv station and goes ballistic. Calls up his agent and says he'sbeen ripped off...
Agent calls Charlie all accusingly and isn't very kind at all. Charlie says he has no idea what's going on. Charlie goes to call Frank and get's an out of service recording. Dilligently, Charlie spends the entire day, in fact 2 days and a night trying to get to the bottom of what has happened.
3 days later, and after personal and business losses to Charlie for having to divert resources and attention to the matter, he finally has all ofthe parties in the loop and has explained that there is an agreement that was signed by Frank that stipulates the usage was limited to the internet. Frank has indicated that information was passed on to the account rep at Big Pisano's, unfortunately she is now working in Rhode Island selloing internet squeeze pages.
Pisano's agrees that the talent should be compensated. At this point, the talnt agent sensing they have Pisano's over a barrell asks for a fee that's almost double what they normally charge.
Finally when it's all over they settle on something for the talent that's about a third higher.
The end result though is that Charlie is never dealing with this talent agent again. They could have handled things a considerable bit better.
Next project comes along and it is a huge e-learning project, Charlie calls me and I have my 6 closest local v.o. friends audition for it. One of them books it. Lost commissions to the talnt agent are well in excess of what they made by putting the screws to Charlie.
We all mistakes. The system, even in union situations is far from perfect and I can also tell you that it is possible that a signatory is processing a union payment to you for the tv spots as we speak. I get mystery checks all the time from lifts of existing spots - movement to new media or even when they just use an audition as a job.
The above story has been somewhat changed to protect the guilty and the innocent, but it happens all the time. _________________ j.s. gilbert

The ladies in the sales department don't know jack about this stuff.
I am not pissed off at them for doing a splendid job of selling ads!
