VO-BB - 20 YEARS OLD!

Well hello! It's been a while since I've posted here.

I ran this by the venerable DB Cooper before posting here (the subject is a direct quote from her).

My wife, Judy, and I have a dear friend named Deanna here in Oregon whom I've worked with in radio in the past. She has recently left her job to take on a new position as a morning show co-host. Her former employer has decided to hold her to an old non-compete. Non-competes were pretty much outlawed here in Oregon in 2008. Her contract was signed in 2007.

The former boss has agreed to drop his pursuit of the non-compete if she'll pay all accrued legal fees. She could fight it, but it would keep her out of work for another 6 months.

Judy and I have set up a Chip-In account to help Deanna raise the roughly $1500 she'd need to put this behind her and start working again.

All monies collected will go to Deanna (minus PayPal fees).

I think it's great that you are helping this woman but I am curious. Has the former boss successfully obtained a court order to prevent her from working at the new station or has he merely sicced his lawyers on her to threaten her with legal action?

I'm no liar... er.. lawyer... but the way I understand this is:

There's currently a cease & desist in place and new employer's lawyers won't clear her for work until its been lifted.

There is no final judgement in the case and the threat of lawsuit is against her personally as well as new employer. She can fight it and her attorney is confident she'd prevail, however, this would keep her unemployable for another 6 to 8 months (almost the rest of the term of her non-compete).

The offer has been extended to lift the C&D if she'll cover attorney's fees to this point.

So... this is nothing to do with the law or the courts. This is just two sets of lawyers making money off their respective clients. A "cease and desist" is just an opening shot letting the other lawyer know that the game is afoot and there are fees to be racked-up. We collectively hand the lawyers the KY... and don't even complain when we have to buy our own flowers.

Give each lawyer a baseball bat and put them in a cage. Attrition is the only way to solve the problems of an overly litigious society. Make it a blood sport and sell tickets.

I understand that this is a battle of attorneys at this point. The fact remains, that there is a young lady who cannot work and support her family right now.

I've asked Chip-In why I'm not seeing updated amounts on the site, but their support is limited (its a free service).

We're to almost $500 at this point, but the contributions have waned over the weekend. $1, $5, or $10 gets the job done.

Just wanted to post a quick update. Deanna and her new employer have come to terms with her former employer. She begins collecting a paycheck next week!

You guys helped put a sizable dent in Deanna's legal fees. Thank you so much!

She wanted me to pass on that she feels so blessed for wonderful people who would help out a complete stranger.
